Anatomy of Timeshare Relief Consultants

If you own a timeshare, there’s a good chance you’ve been contacted out of the blue by someone claiming to be a timeshare relief consultant. These people have been preying on timeshare owners for years. These fraudsters typically contact you by phone or mail even when you never asked them to and offer to take your timeshare off your hands. Before you spend any money with these so-called consultants, get the facts here first.

Timeshare relief consultants come in many forms. Back in 2010 – 2011 these were commonly referred to as postcard companies because they’d send postcards like this one to get customers on the phone:

When you call for more information, their sales representatives might say they have a buyer waiting to purchase your timeshare for a significant amount of cash. All you must do is send them thousands of dollars to complete the transaction. When you pay them the money they disappear into the wind.
 
A different approach a timeshare relief company might take is to get you to sign a Power of Attorney that gives them the authority to try and get you out of your timeshare contract. The timeshare relief company won’t promise you any money for your timeshare and instead will charge you thousands of dollars to take the timeshare off your hands. Once you’ve signed, they may try to transfer the timeshare out of your name to a ‘shell’ company as we explained in this article. Or, they may never actually transfer the ownership out of your name after taking your money, leaving you on the hook for the maintenance fees, so this should be avoided at all costs.
 
This approach has become so common over the years that many resort developers are wising up to the practice. When the resort developer receives a request to transfer your timeshare to an LLC it may choose to cancel the transfer altogether. If this happens, the timeshare relief consultants you were working with may choose to keep your money for their ‘work’ and leave you with your timeshare ownership.
 
Keep in mind that when you sign a Power of Attorney you still own the timeshare and will be responsible for its maintenance fees. A timeshare relief company may tell you to stop paying your timeshare maintenance fees while they undergo the transfer of your timeshare to the ‘shell’ company, but you’ll only be hurting your own credit score in the end if the resort reports you for non-payment.
 
Before engaging with a timeshare relief company, ask yourself the following questions.
 

How did this person get my contact information?

Answer: If you did not previously request information about transferring your timeshare, then they are cold calling you and just trying to get your money.
 

Why won’t this person tell me the name and address of the person or company who is responsible for paying my maintenance fees and expenses after the transfer?

Answer: Because they don’t plan to transfer the timeshare out of your name even though they told you they would.
 

Why won’t this person accept my credit card for payment?

Answer: Because they do not want the transaction to be traced, especially if they are acting to circumvent a law.
